These terms and conditions govern the use of the TrichoSuite platform. By accessing or using our services, you accept these terms.

1. Service description

TrichoSuite is a SaaS platform designed for hair transplant clinics. It provides patient management tools, 3D scanning, graft calculator and patient portal.

2. User account

You are responsible for maintaining the confidentiality of your account and password. You must notify us immediately of any unauthorized use of your account.

3. Medical data

The user is responsible for processing their patients' medical data in accordance with applicable legislation. TrichoSuite acts as a data processor according to the terms of the data processing agreement.

4. Intellectual property

All content, design, code and functionality of TrichoSuite is the property of TrichoSuite or its licensors. No intellectual property rights are granted to the user beyond the use of the service.

5. Limitation of liability

TrichoSuite shall not be liable for indirect, incidental, or consequential damages arising from the use of the service. Our total liability shall not exceed the amount paid in the last 12 months.

6. Termination

We may suspend or terminate your access if you breach these terms. In case of termination, we will export your data as required by applicable law.

7. Service Level Agreement (SLA)

TrichoSuite commits to a 99.9% monthly uptime target for the platform. Scheduled maintenance windows will be communicated at least 48 hours in advance and will occur outside of peak business hours (CET). In the event of unplanned downtime exceeding the SLA target, affected customers will receive proportional service credits. Support response times: Critical issues (P1) within 1 hour, High (P2) within 4 hours, Normal (P3) within 24 hours, Low (P4) within 72 hours.

8. Data Export and Portability

Upon termination or at any time during the subscription, you may request a full export of your data in standard formats (CSV, JSON, PDF). Medical records, patient data, 3D scans, and documents will be provided within 30 days of request. TrichoSuite will retain a backup for 90 days post-termination, after which all data will be securely deleted unless retention is required by law.

9. Acceptable Use

You agree not to: (a) use the platform for any unlawful purpose or in violation of medical regulations; (b) attempt to access other users' data or clinic accounts; (c) reverse engineer, decompile, or disassemble any part of the platform; (d) transmit malware, viruses, or harmful code; (e) use the platform to store or process data unrelated to clinical operations; (f) share login credentials or allow unauthorized access to your account.

10. Modifications to Terms

TrichoSuite reserves the right to modify these terms. Material changes will be notified via email at least 30 days before taking effect. Continued use of the platform after the effective date constitutes acceptance. If you disagree with the changes, you may terminate your subscription and request a data export.

11. Dispute Resolution

Any disputes arising from these terms shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, it shall be submitted to mediation under the rules of the Spanish Mediation Act (Ley 5/2012). If mediation fails, the dispute shall be resolved by the Courts and Tribunals of Madrid, Spain.

12. Governing Law

These terms are governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. For consumers within the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.

13. Regulatory Compliance

TrichoSuite is designed to help clinics comply with applicable healthcare and data protection regulations including GDPR (EU 2016/679), LOPDGDD (LO 3/2018), LSSI-CE, the Spanish Patient Autonomy Act (Ley 41/2002), and VeriFACTU electronic invoicing requirements (RD 1007/2023). However, each clinic remains ultimately responsible for their own regulatory compliance.
